AUBURN — A preliminary accident report from the Androscoggin County Sheriff’s Office found that a pedestrian entered Park Street and failed to yield the right of way to a Livermore Falls police cruiser in a fatal accident late on Oct. 28.

Pedestrian Joseph Slaver, 23, of Livermore Falls, died Oct. 31 from injuries suffered in the accident.

According to the report submitted by Deputy Troy Young, the cruiser driven by Patrolman Troy Reed, 25, of Farmington was southbound when Slaver entered the roadway in a dart/dash from the west side of the road in an easterly direction.

The pedestrian failed to yield the right of way to (the cruiser), striking the front passenger quarter panel and windshield of the (cruiser),” Young wrote in the report.

The accident occurred on a dark, rainy night on a curve in the road across the street from 554 Park St., where Slaver lived, according to a diagram in the accident report. Park Street is also Route 133.

The report also found that Reed was not distracted at the time of the accident.

The Sheriff’s Office is still waiting for toxicology results from both Reed and Slaver as the investigation continues, Chief Deputy William Gagne said.

Once all of the information is in, Young will present a final report to the District Attorney’s Office for review.

The DA’s Office has been involved from the beginning, Gagne said. It will make the decision on whether charges are filed.
