FARMINGTON — Two local men were indicted Wednesday on charges they sold cocaine from their apartment within 1,000 feet of a drug-free zone in January.
Omer Havtan, 21, and Jonathan Toothaker, 22, both of Farmington were sharing an apartment at 164 Broadway at the time, according to officials.
Havtan was indicted by a Franklin County grand jury on three felony charges of aggravated trafficking in cocaine, Xanax and marijuana and a misdemeanor charge of violation of condition of release stemming from a March 18 incident. He was indicted on criminal forfeiture of property, namely $4,629, which police said was drug money.
Toothaker was indicted on a felony charge of aggravated trafficking in cocaine and a misdemeanor charge of violation of condition of release.
The drug charges were elevated because the apartment is within 1,000 feet of Meetinghouse Park.
Farmington police got a warrant to search Havtan’s apartment, found cocaine and marijuana and arrested him Jan. 12.
They also arrested Toothaker that day on a charge of violating conditions of bail, which prohibited him from possessing drugs and engaging in new criminal activity, Police Chief Jack Peck previously said. Police executed other search warrants, including one for Toothaker’s cellphone and found calls suggesting he was trafficking drugs and selling cocaine from the apartment, Peck said.
Toothaker was arrested Jan. 21 on a felony charge of aggravated trafficking in cocaine and a misdemeanor charge of violation condition of release.
A conviction for cocaine trafficking is punishable by a maximum 30 years in prison and a $50,000 fine. A conviction for trafficking in marijuana and Xanax carries a penalty of up to five years in prison and $5,000 fine. Conviction for violation release conditions is punishable by up to six months in jail and a $1,000 fine.
