AUBURN — A Lewiston woman was indicted on a charge stemming from what police said was a hammer attack on her boyfriend.

An Androscoggin County grand jury handed up an indictment Tuesday against Crystal Foss, 33, of 242 Park St. on a charge of aggravated assault, a Class B crime, punishable by up to 10 years in prison.

Defense attorney Henry Griffin wrote in a motion for bail review in May that Foss suffers from “longstanding mental health issues that require intensive treatment.”

Her bail was changed from $2,500 cash to personal recognizance and a contract with Maine Pretrial Services, an independent local supervisory agency.

According to a police report, Foss’ 47-year-old boyfriend said she struck him in the head with a hammer when he walked through their apartment door on the afternoon of April 5. After he fell to the ground, Foss kicked him in the ribs, he said, but added he didn’t want Foss to go to jail, Cpl. Matthew Vierling wrote in his affidavit in support of Foss’ arrest on the assault charge.

Ambulance crews noted at least three lacerations on the victim’s head.

Foss told another officer at the scene that she had struck her boyfriend with a hammer. Police found a hammer with dried blood on it on a stool in the apartment’s kitchen.

Conditions of Foss’ pretrial contract include no contact with the victim, plus no possession of alcohol nor dangerous weapons. She can be searched at random without suspicion.
