TURNER — Selectmen held an executive session Tuesday evening to discuss the status of the court case filed by Turner in opposition to a SAD 52 land sale to Greene.

The attorney representing Turner, James Belleau, participated via conference call, according to Town Manager Kurt Schaub.

Arguments were heard on June 1. The judge granted a temporary stay, preventing the sale from going forward until a settlement conference on June 14.

At issue is an SAD 52 proposal to sell a 73-acre parcel to Greene that was originally purchased by the district for a new school that was never built. Turner selectmen have objected to the $40,000 sale price. The property was obtained in 1991 for around $83,000 and is assessed by the town of Greene at $73,000.

The board was informed that no agreement has been reached between Androscoggin County commissioners and the towns of Androscoggin County in the ongoing lawsuit between them. Representatives of the municipalities that filed the suit met with county commissioners on June 2.

According to Schaub, commissioners refused to relinquish the right to set their own salaries without accountability to the county Budget Committee, which is what led to the court action initially. Commissioners have argued that the law gave them the right to set their own salaries.

Schaub reported that as of June 1 residents pay $8 for mattress disposal at the Transfer Station. “We encouraged to prepay at the Town Office,” Schaub said, but payments are also accepted on site at the time of disposal.

Fire Chief Rodney Guptil said the recent Hartford woods fire was a result of a man burning without a permit. The town has billed the individual responsible for over $3,000, which covers $125 per vehicle called to the scene and $25 per hour for each person called to the scene.

Guptill said the department was given a K12 circular saw by the Turner Fire Association. He said it’s “like the one that Auburn used to cut through the roof” at the Bisson Warehouse fire in January.

Rescue Chief Lisa Bennett said she received the long overdue $3,000 for the sale the old rescue vehicle. She also said collection letters have been sent via the Thomas Agency for over $7,000 on 80 accounts for rescue services.

Bennett said she attended the recent Leeds selectmen meeting where the selectmen accepted the rescue contract offered by Turner.

Selectmen voted unanimously to grant All States Asphalt of Windham a $197,500 contract for cold mix asphalt. The company also received the contract for hot mix asphalt.

Board of Selectmen Chairman Kurt Youland said because of the great price they got from the company, “we’re thinking about adding an extra 1,200 tons” to complete more road repairs, bringing the cost to just under $200,000.

Spencer Group Paving will lay the asphalt.

Schaub distributed financial statements and pointed out that excise tax revenues are “well ahead of projection.”

The board agreed to table a discussion of a letter written by Planning Board Chairman Thomas Perkins on the topic of zoning standards for motor vehicle sales sites.

The next selectmen meeting is June 20 at the Town Office.
