AUBURN — A Lewiston man who claims to have been involved in a hold-up prank at Dunkin’ Donuts last year was charged Tuesday with felony violation of condition of release.

Police said Billy Wilson, 21, of 50 Fairmount St., Lewiston, was carrying a gun while at the Auburn Mall on Feb. 16.

Police wrote in a sworn statement that they spotted Wilson at the Shoe Depot, matching the description of a man at Olympia Sports whom a caller had reported as being a felon carrying a gun.

Wilson was with a man identified as Nicholas Gibbens, a co-defendant in the Dunkin’ Donuts incident.

Conditions of Wilson’s bail conditions include no use of possession of dangerous weapons, being subject to random search and no contact with Gibbens.

Wilson was arrested on a charge of violating bail conditions, a Class C felony, punishable by up to five years in prison.

Wilson and Gibbens were charged with robbery after they reportedly held up a Dunkin’ Donuts in August as a prank. The cashier turned the tables on the pair when he pulled a gun on them after quizzing them about robbing the coffee shop.

Gibbens, 24, of 23 Eaton St., Lewiston, admitted earlier this month in Androscoggin County Superior Court to a charge of criminal threatening. A felony robbery charge was dismissed by prosecutors.

Wilson is free on $1,000 cash bail.

The Dunkin’ Donuts clerk told police the two men had come into the store shortly before 2:30 a.m. on Aug. 23 and asked if he was alone, according to court papers.

The clerk asked them what he could get them.

The men said, “All of your money.”

The clerk asked if they were robbing him. They said they were.

He asked them if they were joking. They said they were not.

The clerk again asked if the two were robbing him. They said they were.

At that point, the clerk, who had a concealed handgun permit, revealed a gun and pointed it at the men.
