FARMINGTON — A local man pleaded guilty Thursday to sexually assaulting a woman in an apartment in Farmington on June 29, 2014.
Jonathan Dumont, 29, pleaded guilty in Franklin County Superior Court to the Class A charge, which carries a penalty of up to 30 years in prison and a $50,000 fine.
The state dismissed two identical charges in the plea agreement.
Justice William Stokes tentatively set sentencing for 1 p.m. Wednesday, Feb. 11, at the court to allow the victim to be notified of the proposed resolution. The state was unable to reach her Thursday but expected to do so soon.
Assistant District Attorney Claire Andrews said the recommended sentence is 10 years to the Department of Corrections with all but five years suspended. Upon his release from prison, Dumont will be on probation for four years. He will be required to register as a sex offender.
If the case had gone to trial, Andrews said the court would have heard that Dumont went to an apartment with another man to help move an object. While there, the victim said she needed help with her door. Dumont, who she did not know, told her he had the tools and would be back to fix the door.
Dumont returned to the apartment a short time later and asked that a member of the woman’s family leave while he fixed the door, and she did, according to the state’s evidence.
The victim, who gets around with a walking aid, would testify that she was sitting in a recliner and Dumont got on top of her and engaged in a sex act. The victim got up and went to the bedroom and Dumont followed her and committed more sex acts against her, according to Andrews.
The family member would have testified that she returned to the apartment and could hear the victim crying and repeatedly saying no. The family member went to the bedroom and saw Dumont committing the sex act.
Farmington police Sgt. Edward Hastings IV would have testified that the victim reported the incident the following day and the women went to the hospital where DNA was collected. He would also have testified that he interviewed Dumont, who initially denied the sexual assault but eventually admitted to it.
Stokes accepted Dumont’s plea.
He is being held without bail pending sentencing.
Dumont’s attorney, Philip Mohlar, requested that the court release the $20,000 cash bail that Dumont’s stepfather put up to get him out of jail after he was arrested.
Stokes approved it as long as a $35 assessment fee is paid at sentencing.
