FARMINGTON — A legal notice serving Amanda Huard and her daughter with a lawsuit from a Somerset County mother of an infant who died in 2012 while Huard was baby-sitting was published Friday in the Sun Journal.

Maine Superior Court Justice Michaela Murphy approved serving the suit through a newspaper ad after Huard could not be located at her former residence in Fairfield or at an apartment in Jay.

According to the notice, Nicole Foss-Greenaway filed the lawsuit, claiming 3-month-old Brooklyn Foss-Greenaway died as a result of the negligent action of Amanda Huard in supervising her daughter, who was 10 at the time, and the intentional and negligent acts of her daughter on July 8, 2012, at their home in Fairfield.

In May, Huard’s daughter admitted to lesser charges related to the death of the child and the state dropped a manslaughter charge against her.

The attorney representing Huard’s daughter, John Martin of Skowhegan, said Friday that he filed an answer denying the complaints in the 13-count suit on behalf of Huard’s daughter on July 16.

The lawsuit was served to the child’s custodian, he said, but could not elaborate on who it is.

Among the counts in the lawsuit are Huard’s negligence, including failure to aid and supervise, and negligence of her daughter. The lawsuit asks for unspecified compensation for funeral expenses, conscious suffering, punitive damages and loss of consortium, among other damages.

The notice directs Huard to appear and defend the complaint by filing an answer in Kennebec County Superior Court in Augusta by Sept. 30. If Huard fails to appear and defend, judgment by default will be rendered against her for the relief demanded in the complaint.
