JAY — Police said two men face charges stemming from a fight Sunday night on Old Jay Hill Road.

When officer Nicholas Gulliver arrived, he saw someone running across the road, acting police Chief Richard Caton IV said Tuesday. Gulliver chased the man on foot for a short distance and caught up to Dillian Burnham, 22, of Chesterville, Caton said.

Gulliver heard the sound of something being tossed into the woods during the pursuit, Caton said. When he went back to check, he found an unloaded handgun, Caton said.

Police found evidence in Burnham’s possession that connected him to the handgun, Caton said.

Burnham and Chad Simoneau, 24, of Jay are believed to have been fighting with others outside a home, Caton said.

Burnham was arrested on a misdemeanor charge of refusing to submit to arrest or detention, Caton said.

Simoneau refused to stop yelling and was warned before he was arrested on a misdemeanor charge of disorderly conduct, Caton said.

The incident remains under investigation.

Police spoke to the other people involved but they did not want to press charges against Burnham or Simoneau, Caton said. Witnesses also said they didn’t see a gun, he said.

The gun is not believed to be connected to the fight, Caton said.

Burnham and Simoneau were each released on $100 cash bail Monday from the Franklin County Jail in Farmington. They both are scheduled to appear July 29 in a Farmington court.

Livermore Falls and Wilton police assisted Jay police with the 9:16 p.m. call.
