PORTLAND, Maine (AP) — A judge has thrown out one of the three charges brought against the founder of the Rent-A-Husband home improvement and repair company in Maine.

Justice Thomas Warren has dismissed a charge of selling unregistered securities against Kaile Warren. Warren still faces charges of theft by deception and securities fraud, both felonies.

Assistant Attorney General Michael Colleran said Wednesday that he disagreed with the judge’s interpretation on the count that was dismissed. He says the state is prepared to move forward with the remaining two counts.

Kaile Warren on Wednesday accused Colleran of “prosecutorial misconduct behind closed doors” with the grand jury. He says the judge would’ve tossed the remaining counts if he’d been able to review what happened in the grand jury room.
