FRYEBURG — A mother and son were arrested separately Saturday night after violating conditions of their bail when a domestic assault involving a handgun prompted police action.
Catherine Heinz, the 55-year-old mother, was arrested after a routine bail compliance check at 7:30 p.m. Saturday on charges of violation of conditions of release, according to a media release from the Fryeburg Police Department.
Her original arrest was on a charge of domestic violence assault on Dec. 10.
Heinz’s son, 22-year-old Mark Foster, then got into an altercation with the alleged victim of the original assault, a 59-year-old male.
The assault, which occurred on Lovewell Pond Road, started as an unwanted person on the prand escalated from there. According to the news release, a 9mm handgun was accidentally discharged into the floor during an altercation. The gun was originally in possession of the victim, but Foster eventually disarmed him and struck him repeatedly.
Foster then fled the scene and was located by Sgt. Tim Ontengco of the Oxford County Sheriff’s Office at Rite Aid on Bridgton Road.
Ontengco said there was a report of a disturbance and Fryeburg police were already handling a separate arrest of a resident of the same property so county and state police were called to assist.
Foster was arrested on charges of robbery, possession of a firearm by a prohibited person, aggravated assault, violation of protection order and violation of conditions of release.
Fryeburg Rescue responded to treat the unnamed victim.
Foster and Heinz are currently being held in Oxford County Jail without bail.
